Terms and Conditions
com.medatlas.app (Android) and com.medatlas.ios (iOS/iPadOS) apps, to the desktop application for Windows and macOS, and to the web/PWA version. In short: Epistemis is an educational tool for studying and revising Medicine. It is not a medical device and it is not for diagnosing or treating anyone: nothing you see here should be used to make a decision about a real patient without verifying it. Using it means accepting these terms. It works without an account; if you create one, you are responsible for it. Today it is entirely free; there will be optional paid features, handled by the store you installed the app from (Google Play or the App Store) or, if you buy from a computer or browser, by Lemon Squeezy. The content is ours or is under licences we respect; you keep whatever you write.
This is an English translation of the Spanish original. If the two ever diverge, the Spanish version prevails.
Contents
1. Acceptance of the terms
These Terms and Conditions (“Terms”) govern use of the Epistemis application and its web version (“the app”, “the service”). By installing, opening or using the app you agree to be bound by them. If you disagree, do not use the app.
These Terms are complemented by the Privacy Policy, which forms an integral part of this agreement.
2. Who provides Epistemis
Epistemis is an independent educational project developed and maintained by its developer, reachable at soporte@somatryx.com. It is not affiliated with, sponsored by or endorsed by any university, scientific society, examining body (MIR, USMLE or others) or health authority.
3. Intended use and regulatory status important
Epistemis is intended for the training and revision of students and health professionals. It is not intended for the diagnosis, prevention, monitoring, prognosis or treatment of any disease in any specific patient and is therefore not a medical device within the meaning of Regulation (EU) 2017/745 (MDR), nor software as a medical device (SaMD) within the meaning of FDA rules. It carries no medical CE marking and no authorisation from any regulatory agency, because its intended use does not require one.
What that means in practice. The calculators, scales, algorithms, doses and protocols reproduce published rules so that you learn to apply them, not to calculate anyone's treatment. AI reading of images and ECGs teaches you to read: it describes findings and proposes differentials, and issues no reports and no diagnoses. No feature is designed to be used during patient care as clinical decision support. If your institution needs a validated, certified decision-support tool, Epistemis is not one and must not be used as such.
Every clinical decision is the sole responsibility of the professional who takes it, with the patient present, their full medical history and the guidelines in force.
4. Requirements and eligibility
- You must be at least 13. If your country's law requires a higher age to accept digital contracts or to consent to data processing, you must meet it or have authorisation from whoever holds guardianship over you.
- The app is designed for students and health professionals. Anyone may use it, but the content presupposes medical training and is not written for patients or the general public.
- You need a compatible device. The app works offline; some features (account, syncing, AI, purchases) require the internet.
5. Account and syncing
Epistemis works without an account. Creating one is optional and serves only to sync your progress across devices and to use the included AI tutor.
- You are responsible for the accuracy of the data you provide and for keeping your credentials confidential.
- You are responsible for activity carried out from your account. Tell us if you detect unauthorised use.
- An account is personal and non-transferable. Do not share or resell it.
- You can delete your account and your data at any time from Settings › Account, or from this page. Doing so erases your progress document in the cloud; whatever is stored on the device is removed by uninstalling the app or clearing its data.
The detail of what data is processed and on what legal basis is in the Privacy Policy.
6. Permitted and prohibited use
You are granted a personal, limited, revocable, non-exclusive and non-transferable licence to use Epistemis for your own study and revision.
You may not:
- Copy, bulk-extract, redistribute, resell, sublicense or publish the app's content, whether in its original or a transformed form, beyond personal study use.
- Decompile, reverse-engineer or attempt to obtain the app's source code or keys, except to the extent the law mandatorily permits.
- Circumvent technical limitations, AI usage quotas, paid-feature walls or access controls.
- Use the app or its content to make real clinical decisions without the verification and professional judgement required.
- Upload to the AI features images or identifying data of real patients (name, record number, date of birth) or material you have no right to use.
- Use the service for unlawful purposes, to infringe third-party rights, or to interfere with its operation (abusive automation, overloading, intrusion).
- Present the content as your own, as official exam material, or as endorsed by an institution.
7. Premium subscription and Founder programme
Epistemis is entirely free today and there is no active charge. This section describes how the subscription will work once switched on, and it is published in advance so the conditions are known beforehand and not on the purchase screen.
Epistemis offers optional paid features via an auto-renewing subscription. Who charges you depends on where you buy it:
- On Android and on iPhone/iPad, through the store you installed the app from: Google Play or the App Store.
- On desktop and in the browser (desktop application and web version), where no such store exists, via web purchase processed by Lemon Squeezy, acting as merchant of record for that transaction: they charge you, issue the invoice and remit any taxes due in your country.
Whichever route you take, the subscription is the same one and unlocks the same features on all your devices with the same account. There is no need to pay twice.
7.1 Announced prices
| Market | Monthly | Yearly |
|---|---|---|
| Colombia (COP) | $ 39,900 | $ 239,900 |
| Rest of the world (USD) | US$ 17.99 | US$ 107.99 |
In other countries the amount appears in your local currency, converted by the store itself — or by Lemon Squeezy for web purchases — from the US dollar price and adjusted to its usual rounding. The yearly plan costs half of twelve separate months in both currencies.
The price that counts is the one shown on the purchase screen, with your country's taxes already included — not the one in this table, nor the one the app displays offline, which is indicative. If they differ, the purchase screen governs.
7.2 Subscription conditions
- Free trial: subscriptions are offered with a 7-day trial period, free of charge and limited to one use per store account. If you do not cancel before it ends, the subscription continues and the first period is charged.
- The amount is charged when you confirm the purchase — or when the trial ends — and on each renewal, through your store account, until you cancel. Renewal is avoided by cancelling at least 24 hours before the end of the current period.
- You can cancel whenever you want from Google Play → Payments and subscriptions, from Settings → [your name] → Subscriptions on iOS, or — if you bought from a computer or browser — from the “Manage subscription” link on the Premium screen, which opens the Lemon Squeezy billing portal. Cancellation takes effect at the end of the period already paid for, with no refund of the current period.
- Epistemis never receives or stores your payment details: payment is processed entirely by the relevant provider (the store, or Lemon Squeezy for web purchases).
- Refunds are governed by the policies of whichever provider took the payment — Google Play, the App Store or Lemon Squeezy — and by whatever rights applicable consumer law gives you: in Colombia, the right of withdrawal under Law 1480 of 2011 where applicable. Requests are handled by that provider, not by Epistemis. For web purchases, request one from the same billing portal or by writing to soporte@somatryx.com, who will pass it on.
- Prices may vary by country, taxes and exchange rate. Any price change to an active subscription will be notified as far in advance as the store requires; it never applies to a period already paid for, and where the store's policy or the law requires it, your express consent will be needed to keep charging you — if you do not give it, the subscription is cancelled rather than renewed at the new price.
- The Founder programme is a time-limited promotional condition for the first people to use the app. It grants 3 months of Premium at no cost, sealed at the sign-up date: if the programme changes later, whoever is already in keeps their period. It is independent of the free trial and does not consume it. It closes on the date announced in the app or on reaching the founder cap, whichever comes first. It covers the base plan; it does not include unlimited managed AI (see section 8). It creates no rights beyond those stated in the app at the time of sign-up.
- The features included in Premium may evolve. If a paid feature is substantially and permanently withdrawn, you will be informed inside the app.
What Premium does not include: access to the app's medical knowledge is not for sale. Premium covers practice and productivity features, not the core educational content. Nor does Premium grant unlimited AI: see the next section.
8. AI tutor (Clio)
Epistemis integrates a tutor based on third-party language models. It can be used in two ways:
| Mode | Who pays | Limits |
|---|---|---|
| Clio included | Epistemis | Requires signing in. Has a monthly quota per person, renewed on the 1st of each month. Once exhausted, the feature is unavailable until renewal. |
| Your own key | You, to your provider | No limit from Epistemis. The key is stored on your device only. |
- AI answers may contain errors, even when expressed with apparent confidence. They are educational material and must always be verified against clinical sources.
- Your queries are sent to an external AI provider in order to answer them: straight from your device if you use your own key, or via the Epistemis relay if you use Clio included. Providers act as sub-processors and are identified in the Privacy Policy.
- The AI issues no diagnoses and no reports. It describes findings and proposes differentials for teaching purposes (see section 3).
- We reserve the right to adjust quotas, change provider or temporarily suspend the feature if cost or abuse make it necessary, giving notice in the app.
- Using the AI to generate unlawful content, to circumvent its limits, or to process identifiable real-patient data is prohibited.
9. Your content
The notes, cards, decks, highlights, answers and conversations you create are yours. We claim no ownership over them and we do not use them to train models.
You grant us only the technical licence strictly needed to store and sync them if you enable the account, and to transmit them to the AI provider when you launch a query. You can export and delete them whenever you want.
You are responsible for ensuring the content you upload does not infringe third-party rights and contains no patient personal data.
10. Intellectual property
The software, the design, the “Epistemis” brand, the interface, the text written for the app, the diagrams, the question banks, the cases, the mnemonics and the organisation of the content are protected by intellectual property rights and belong to its developer or its licensors.
These Terms transfer no ownership rights to you: only the licence to use described in section 6. Third-party trade marks, names and logos that appear (Google Play, Firebase, the AI providers, the image sources) belong to their owners and are cited for identification purposes only.
11. Clinical images and third-party licences
The image atlases (radiology, histology, pathology, dermatology, anatomy, fundus, smears, ECG, auscultation and basic sciences) gather material from open repositories under licences that permit their use, with whatever attribution each licence requires. The provenance and licence of each item are stated in the app itself and on the Trust page.
- Those licences cover use inside Epistemis. They do not authorise you to extract the images and redistribute them on your own.
- If you hold rights over any material and believe its inclusion is incorrect, write to us and we will remove it or correct the attribution promptly.
12. Availability, updates and changes to the service
Downloaded content works offline. Online features (account, syncing, AI, purchases, content updates) depend on third parties and may be interrupted by maintenance, incidents or causes beyond our control.
We may update, modify, add or withdraw features and content to improve the app, fix errors or comply with regulations. We will endeavour to announce substantial changes inside the app. We do not guarantee indefinite availability of the service or of any particular feature.
13. Disclaimer of warranties
To the extent permitted by law, Epistemis is provided “as is” and “as available”, without express or implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness or currency of the content.
Medical knowledge changes. Despite the review effort, the content may contain errors or omissions, or become out of date, and doses, criteria and protocols must always be checked against current sources before any application.
None of the above excludes the statutory guarantees to which you are entitled as a consumer and which cannot be excluded by contract.
14. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special or consequential damages, nor for loss of profit or loss of data, arising from the use of or inability to use the app.
In particular, and given its educational nature, we accept no liability for clinical, diagnostic or therapeutic decisions taken on the basis of the app's content, the verification of which falls to the professional (section 3).
Where liability exists and cannot be excluded, it will be limited to the amount you have paid for the service in the twelve months before the event giving rise to it.
These limitations do not apply to wilful misconduct, gross negligence, or damage to life, physical integrity or health, nor to any liability that mandatory law does not allow to be excluded.
15. Suspension and termination
You can stop using Epistemis whenever you want by uninstalling the app and, if you have an account, deleting it.
We may suspend or cancel access — in whole or in part — if you breach these Terms seriously or repeatedly, if we detect fraudulent or abusive use (for example, of the AI quota or of purchases), or if the law requires it. Unless disproportionate or impossible, we will give notice first. Cancellation for breach gives no right to a refund of periods already enjoyed.
The sections on intellectual property, disclaimer of warranties, limitation of liability and governing law survive termination.
16. Governing law and complaints
These Terms are governed by Colombian law, without prejudice to the mandatory consumer-protection rules of your country of habitual residence, which apply where they are more favourable to you.
Before going to court, we ask you to write to soporte@somatryx.com: most issues are resolved that way. If you are a consumer, you keep the right to go to the courts of your domicile and to the dispute-resolution mechanisms the law makes available to you.
If any clause is held void or unenforceable, the rest remains in force and that clause will be replaced by a valid one of equivalent effect.
17. Changes to these terms
We may update these Terms to reflect changes in the app, in third-party services or in regulations. We will publish the version in force on this same page and update the date at the top. Substantial changes will be communicated inside the app with reasonable notice; continuing to use the service after they take effect constitutes acceptance. If you do not accept them, you can stop using the app and, where applicable, cancel your subscription.
